The reason for not giving compensation to Persepolis in the Lokadia case from Hedayati’s language

Homan Hedayati, legal vice president of Persepolis club, said about the Lokadia case: “What is in the regulations of the committee for determining the status of players, FIFA has not determined a specific measure and criteria for the damage caused.” Of course, the parties can foresee in their contract and if they have not done this. FIFA will review the details of the termination of the contract. In the first stage, Persepolis Club announced to FIFA all the documents to prove the player’s losses in various bills, and this executive body wrote that I checked all these documents and it was proven to me that this player had terminated his contract unjustifiably. And secondly, he paid 324,000 dollars to the Persepolis club to cancel the damage. But Leucadia is appealing and the case was reviewed by CAS.

He added: The CAS court is more open in referring to the laws and can refer to the Swiss laws, and this court has discussed the Lokadia case in 115 paragraphs and has several key points. Termination is considered as the last solution to end the contract, and the Persepolis club, the party to the contract, had no role in the termination of the Leukadia contract. The termination of this player’s contract on December 25, 2022 was not justified. Although in the following parts of the vote, it has mentioned non-football issues, but overall, FIFA and CAS confirmed that Persepolis Club had no role. The CAS court stated that I have a duty to come and investigate the damage.

Hedayati said about Lokadia canceling his contract with Force Majeure: No, Lokadia canceled his contract himself. When this player left Iran, 10-15 days later, a lawyer sent an email on behalf of this player to the Persepolis club saying that we want to cancel the contract with Lucadia. This player took leave and left Iran to come back again, but he chose not to return. Persepolis club announced in an email to Lokadia’s lawyer that we need this player and he should return faster and we are on the verge of an important game. We are not willing to terminate the contract at all and we are willing to discuss any problem.

The Legal Vice President of Persepolis Club said: We participated in the appeal hearing in the CAS court online, and in parts of the hearing, various non-football issues were discussed, and Lokadia’s lawyers tried very hard to raise various issues, and my colleagues and I were very interested in this. We became sensitive and protested. I said somewhere in the meeting that you are holding a human rights court and this is a football issue. If you are a CAS authority and you are talking about football, you cannot talk about unproven and untrue issues because tens of thousands of foreigners are working in Iran in the form of foreign companies. We cannot accept that only one person is in trouble in Iran. The CAS referee was a listener and Lokadia’s lawyers repeated non-football issues and we were also in our position, but at the end of this petition they wrote that Persepolis club replaced Lokadia with a player whose value was lower than Lokadia’s. The lawyers of this player also said this in their defense. They said that Persepolis did not lose money and did not suffer any damage. Second, we don’t have a transfer for Pereira.

He added: The Ministry of Sports and Youth of our country very quickly gave us the statistics of all foreigners who are active in Iranian sports, and we submitted this to the CAS court as part of our documents. We said that Leucadia is an inner feeling that he created in himself, while tens of thousands of foreigners are active in Iran and we gave a list. CAS has ruled against FIFA.

Hedayati said about the fact that the Persepolis team could not sign a contract with Lokadia that would benefit them: I have no role in concluding the contract of a foreign player in the Persepolis club and our colleagues in the club are more knowledgeable than me. Normally, we don’t have the upper hand in contracts, and it’s not like I can bet 30 on a foreign player’s contract. For Wilmots, we could not put a clause in his contract.

The Legal Vice President of Persepolis Club said that Persepolis Club announced at the same time that we signed a contract in such a way that no foreign player could unilaterally terminate his contract. Persepolis club has not suffered. In terms of regulation, the CAS court said, “I can’t consider damages in a way that clubs can profit from.” Damage is a compensation for the loss you saw. The CAS court says that when Lucadia is gone and you get a cheap player and become the champion, then you did not lose. They mentioned the issue of Persepolis’ championship in that ruling of Leucadia. If we consider a loss for the Persepolis club, this club will benefit from the termination of the Lokadia contract, and we must make sure that the compensation is equal to the loss. We cannot consider 300,000 dollars compensation for Persepolis club.

He added: We lost our goalkeeper Alireza Biranvand worth 20 billion tomans and we got Algerian goalkeeper Genduz worth 30 billion tomans and we paid about 200, 300 thousand dollars more to attract this goalkeeper and this is a loss.

Hedayati said about the fact that a message was sent from Lokadia to the Persepolis club that he wants to return to this team: No, this issue was not raised in the case and there was nothing like that in the decision. Lokadia’s lawyer said that we want to terminate the contract and we said that we are ready to discuss.

He said about the amount of the legal fees of the Lokadia case being given to Persepolis: I don’t know the amount, but the legal fees were given to the Persepolis club.

About where Nabil Bahoui’s case went, Hedayati said: As far as I know, the money has been deposited into Nabil Bahoui’s account and they should send an email and confirm this.

Regarding the fact that the money from the blocked Persepolis account was supposed to be given to Nabil Bahui, he said: Yes, this money was transferred to Bahui’s account. We must also look at the other part of the case, that we do not destroy the credibility of the name of Iranian football. Of course, we cooperate, and if FIFA wants to transfer our blocked money to the account of a creditor foreign player or coach, we will accept it.
